These Terms of Service ("Terms") govern your access to and use of Carely Hair, including our mobile application and website (the "Service"), operated by Maison du Code LLC ("Carely Hair," "we," or "us"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

1. The Service

Carely Hair is a community-driven platform that helps users track their hair care routines, document progress, discover products, and connect with others. The Service includes features such as progress tracking, community posts, product reviews, routine management, and optional paid subscriptions.

2. Eligibility and Account Requirements

  • Age Requirement: You must be at least 13 years old (or 16 in the EU) to use the Service. If you are under 18, you confirm you have permission from a parent or legal guardian.
  • Account Responsibility: You are responsible for all activity that occurs under your account. Keep your password secure and notify us immediately of any unauthorized access.
  • Accurate Information: Provide accurate and complete information when creating your account and keep it updated.
  • No Impersonation: Do not impersonate others, misrepresent your identity, or claim professional credentials you don't possess (e.g., licensed dermatologist, trichologist).
  • One Account Per Person: Do not create multiple accounts to evade bans, manipulate features, or violate these Terms.

3. User-Generated Content

Your Rights

You retain ownership of content you create and post on Carely Hair (photos, posts, comments, routines, reviews, etc.). We do not claim ownership of your content.

License You Grant Us

By posting content, you grant Carely Hair a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display, and distribute your content. This license is necessary to:

  • Operate and provide the Service (including displaying your posts to other users)
  • Improve and develop new features
  • Moderate content for safety and compliance with our guidelines
  • Promote the Service (e.g., using anonymized or aggregated examples)

This license ends when you delete your content or account, except for content that has been shared by others or where we must retain it for legal reasons.

Content Restrictions

You agree not to post content that:

  • Violates our Community Guidelines
  • Infringes on others' intellectual property, privacy, or other rights
  • Contains malware, viruses, or malicious code
  • Is illegal, fraudulent, or deceptive
  • Promotes self-harm, eating disorders, or dangerous behaviors
  • Shares private information about others without consent

Content Moderation

We reserve the right to remove or moderate content that violates these Terms or our Community Guidelines. We may also remove content that poses safety risks, even if it doesn't explicitly violate the rules. Moderation decisions are made by human reviewers and, in some cases, automated systems.

4. Prohibited Conduct

You agree not to:

  • Harass, bully, threaten, or abuse other users
  • Post spam, unsolicited promotions, or manipulative engagement tactics
  • Attempt to hack, scrape, reverse engineer, or interfere with the Service
  • Use bots, automation, or scripts to access the Service without permission
  • Circumvent security features or access controls
  • Sell, trade, or transfer your account
  • Post misleading medical claims or dangerous health advice
  • Engage in coordinated inauthentic behavior or manipulation

5. Community Guidelines and Enforcement

All users must follow our Community Guidelines. We enforce these guidelines through various actions, including:

  • Content removal or warnings
  • Temporary or permanent account suspension
  • Feature restrictions (e.g., limiting posting or commenting)
  • Reporting to law enforcement in cases of illegal activity or imminent harm

Enforcement actions depend on the severity and frequency of violations. We aim to be fair, but we reserve final discretion in moderation decisions.

6. Subscriptions and Payments (Premium Features)

Premium Subscription

Carely Hair offers an optional "Premium" subscription with additional features. By subscribing, you agree to pay the stated fee on a recurring basis until you cancel.

Billing and Renewals

  • Subscriptions are processed through the App Store (iOS) or Google Play (Android). Billing, payment methods, and renewal policies are governed by those platforms.
  • Subscriptions automatically renew unless you cancel before the renewal date.
  • Prices may change with notice. Existing subscribers will be notified before price changes take effect.

Cancellation and Refunds

  • You can cancel your subscription at any time through your App Store or Google Play account settings.
  • Refunds are handled according to App Store and Google Play policies. We do not control or process refunds.
  • If you're charged in error, contact support@carelyhair.com and we'll work with you to resolve it.

Feature Changes

We may update, modify, or discontinue Premium features over time. We'll make reasonable efforts to notify subscribers of significant changes, but the Service evolves, and features may change.

7. Affiliate Links and Disclosures

Carely Hair may include affiliate links to products. If you purchase through these links, we may earn a commission at no additional cost to you. We disclose affiliate relationships transparently. See our Product Disclosure for details.

8. Intellectual Property

The Service, including its design, features, logos, trademarks, and code, is owned by Maison du Code LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

9. Disclaimers and Limitations

No Medical Advice

Carely Hair is not a medical service and does not provide medical advice. Content on the platform is for informational and community discussion purposes only. If you have health concerns related to your hair or scalp, consult a licensed professional (dermatologist, trichologist, etc.).

User Content Disclaimer

We do not endorse, verify, or guarantee the accuracy of user-generated content. Views expressed by users do not reflect our views.

Service "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

Limitation of Liability

To the fullest extent permitted by law, Carely Hair, Maison du Code LLC, and our affiliates, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from:

  • Your use or inability to use the Service
  • User-generated content or conduct
  • Errors, bugs, or interruptions
  • Unauthorized access or data breaches (despite reasonable security measures)

Our total liability for any claim related to the Service will not exceed the amount you paid us in the past 12 months, or $100 if you haven't paid anything.

10. Indemnification

You agree to indemnify and hold harmless Carely Hair, Maison du Code LLC, and our affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

11. Termination

We may suspend or terminate your account at any time for violations of these Terms, suspicious activity, or for any reason at our discretion. You may also delete your account at any time. Upon termination, your right to use the Service ends immediately.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll notify you via email or through a prominent notice in the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes will be resolved in the courts located in Delaware, and you consent to personal jurisdiction in those courts.

Arbitration (US Users)

For US users, any disputes will be resolved through binding arbitration on an individual basis, not class action. You waive the right to a jury trial or class action lawsuit. This arbitration clause is governed by the Federal Arbitration Act.

14. Miscellaneous

  • Severability: If any provision of these Terms is found invalid, the remaining provisions remain in effect.
  • No Waiver: Our failure to enforce any right or provision doesn't constitute a waiver of that right.
  • Entire Agreement: These Terms, along with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Carely Hair.
